Background

In March 2022, the Governing Board of the Lemon Grove School District held a Public Hearing and approved a Resolution accepting the Developer Fee Justification Study in accordance with Government Code Section 65995 and Education Code Section 17620.

 
All fees are calculated per square foot of assessable space by the local building department for all commercial/industrial and residential construction.  Fees are due prior to the issuance of a building permit.

The Certificate of Compliance generated by the City of Lemon Grove, must be submitted with payment to Lemon Grove School District:

NOTE - School fees are not considered a tax exemption, however, you may want to consult with your tax advisor or CPA for additional information.

 

Exclusions

The following are excluded from the fees: carports, walkways, un-conditioned garages, overhangs or patios, enclosed patios, detached accessory structures or similar enclosed areas, exclusively religious facilities, owned and operated state facilities, owned and operated local agency facilities, construction to make a residential dwelling more accessible to a disabled person (requires a statement from a doctor), reconstruction of a structure destroyed in a disaster, replacement of a manufactured home on the original pad, replacement of a mobile home on the original pad and greenhouses. 

 

Exemptions

Projects that total 500 square feet or less are exempt from school fees.  

 

Other Information

The Lemon Grove School District and Grossmont Union High School District have specified the allocation of the fee revenue to avoid levying a combined total amount that exceeds the maximum fee authorized under Government Code 65995 for non-unified districts that share a common territorial jurisdiction in compliance with Education Code 17623.

 

The Lemon Grove School District may levy up to 62% of the maximum allowable fee as established by the State Allocation Board and Grossmont Union High School District may levy up to 38% of the maximum allowable fee as established by the State Allocation Board.

Building Fees

Where Do Your Fees Go?

Thank you for the payment of school fees.  It is only natural to question where the money goes.

Your fees can pay for the construction and/or reconstruction of school facilities to accommodate enrollment growth resulting from residential, commercial or industrial development projects that occur within Lemon Grove School District boundaries. School fees can also be expended for furniture and equipment for new classrooms.  In addition, an amount not to exceed 3 percent in any fiscal year may be expended by the school district for administration costs incurred by the district to collect the fees.

Section 53080 of the Government Code authorizes the Lemon Grove School District to levy school fees when a new development seeks a Certificate of Compliance from the District.  This certificate is necessary for the developer to obtain a building permit from the applicable city or county.   Section 65995 of the Government Code limits the amount of Statutory School Fees.  Every two years the State Allocation Board (SAB) determines any adjustment to the school fee rate.
